Welcome to Totul.io! These Terms of Service govern your use of our vehicle marketplace platform. By using Totul.io, you agree to these terms. We've written them in plain language so they're easy to understand.

1. Acceptance of Terms

By accessing or using the Totul.io platform, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, you may not use our services.

We may update these terms from time to time. We'll notify you of significant changes, but it's a good idea to review them periodically. Continued use of Totul.io after changes means you accept the updated terms.

2. User Accounts & Registration

To use certain features of Totul.io, you'll need to create an account. Here's what you should know:

  • You must be at least 18 years old to create an account.
  • Provide accurate and complete information during registration.
  • You're responsible for keeping your login credentials secure.
  • One account per person — please don't create multiple accounts.
  • Let us know immediately if you suspect unauthorized access to your account.

Account Verification

We may ask you to verify your email address or identity. This helps us maintain a trustworthy community and prevent fraud.

3. Listing Vehicles

When you list a vehicle on Totul.io, you're responsible for the accuracy of your listing. Here's what we expect:

Seller Responsibilities

All information in your listing must be accurate and truthful, including the vehicle's condition, mileage, history, and any known defects. Misleading listings undermine trust in the marketplace and may result in removal.

Listing Accuracy

Photos must accurately represent the actual vehicle being sold. Use your own photos — don't use stock images or photos from other listings. The price should reflect your genuine asking price.

Prohibited Items

You may only list vehicles that you have the legal right to sell. Stolen vehicles, vehicles with undisclosed liens, and vehicles that cannot be legally registered are strictly prohibited.

4. Buying & Transactions

Totul.io is a marketplace platform that connects buyers and sellers. We are not a party to any transaction between users.

Platform Role

We provide the platform for you to find and connect with other users. The actual sale, transfer of ownership, and payment are between the buyer and seller. Totul.io does not inspect vehicles, guarantee their condition, or handle payments between users.

Buyer Responsibility

As a buyer, you should always inspect a vehicle in person before purchasing, verify the seller's identity and ownership documents, and arrange safe meeting locations for viewings. We strongly recommend having a mechanic inspect any vehicle before you buy.

5. User Content & Intellectual Property

When you post content on Totul.io (listings, reviews, messages, photos), you retain ownership of that content. However, you grant us a license to use it:

  • You grant Totul.io a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.
  • This license exists solely to operate and improve the Totul.io service.
  • You can remove your content at any time by deleting your listings or account.
  • Don't post content that infringes on others' intellectual property rights.

6. Prohibited Conduct

To keep Totul.io safe and trustworthy for everyone, the following activities are not allowed:

  • Posting fraudulent, misleading, or deceptive listings.
  • Harassing, threatening, or abusing other users.
  • Using the platform for any illegal purpose.
  • Scraping, crawling, or automated collection of data from Totul.io.
  • Attempting to circumvent security features or access restrictions.
  • Creating fake accounts or manipulating reviews.
  • Spamming other users with unsolicited messages.
  • Interfering with the proper functioning of the platform.
  • Impersonating another person or entity.
  • Posting content that is obscene, defamatory, or violates any law.

7. Fees & Payments

Totul.io offers both free and paid features. Here's how our pricing works:

Free Listings

Basic vehicle listings are free for individual sellers. You can create listings, upload photos, and communicate with potential buyers at no cost.

Premium Features

We offer optional premium features such as promoted listings and enhanced visibility. Prices for these features are displayed before purchase. All fees are non-refundable unless otherwise stated.

8. Privacy & Data

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Totul.io, you agree to our data practices as described in the Privacy Policy.

Key points: we only collect data necessary to operate the platform, we never sell your personal information to third parties, and you can request deletion of your data at any time.

9. Disclaimers & Limitation of Liability

We work hard to provide a reliable platform, but there are some important limitations:

Platform Provided As-Is

Totul.io is provided "as is" without warranties of any kind, either express or implied. We don't guarantee uninterrupted service, error-free operation, or that the platform will meet all your expectations.

Limitation of Liability

To the maximum extent permitted by law, Totul.io and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes but is not limited to damages from transactions between users, vehicle defects, or data loss.

10. Dispute Resolution

If you have a dispute with another user, we encourage you to try to resolve it directly first. If that doesn't work:

  • Contact our support team — we'll do our best to help mediate.
  • For unresolved disputes, you agree to attempt informal negotiation for at least 30 days before pursuing formal proceedings.
  • Any formal disputes shall be resolved through binding arbitration, except where prohibited by law.
  • You agree to resolve disputes on an individual basis — class actions are not permitted.

11. Termination

You can close your account at any time through your account settings or by contacting our support team.

We may suspend or terminate your account if you violate these terms, engage in prohibited conduct, or if we reasonably believe your account poses a risk to other users or the platform. We'll provide notice when possible, but reserve the right to act immediately when necessary.

12. Changes to Terms

We may modify these Terms of Service from time to time. When we make changes, we'll update the "Last updated" date at the top of this page.

For significant changes, we'll notify you by email or through a prominent notice on the platform. Your continued use of Totul.io after changes take effect means you accept the revised terms.
